Freedom of Expression

Muskegon Community College is committed to protecting freedom of expression, freedom of speech, and the right to peaceably assemble. The College supports individuals and groups exercising these rights on its campuses, consistent with applicable laws and college policies. The purpose of this policy is to facilitate expressive activities while ensuring that such activities do not interfere with college operations, campus safety, or the learning environment.

 For individuals lawfully present on MCC campuses, outdoor common areas are designated as venues for free expression, including spontaneous expression, speeches, demonstrations, and distribution of information. Individuals or groups wishing to engage in commercial solicitation must reserve time and space in accordance with college procedures.

 For purposes of this policy, examples of expression include, but are not limited to:

• Group activities
• Speeches, performances, demonstrations, parades, marches, rallies, vigils, and similar events
• Distribution of informational materials such as circulars, newspapers, leaflets, and pamphlets
• Any other expression protected by the First Amendment to the U.S. Constitution

 Requests related to Freedom of Expression activities should be directed to the Chief Compliance & Title IX Officer, Kenneth James, at kenneth.james@muskegoncc.edu or the Dean of Student Services, Patti Davignon, at patti.davignon@muskegoncc.edu  Requests should be submitted at least two business days in advance when possible.

 MCC retains its jurisdiction to regulate the time, place, and manner of expressive activities when enforcing this policy but shall not restrict students’ expression based on concerns about other person(s)’ negative reaction to the expression. MCC will also take reasonable steps to ensure campus safety while allowing expressive activities to continue unless College operations are materially and substantially disrupted.

 For purposes of this policy, outdoor common areas include lawns, sidewalks, benches, and other outdoor spaces not otherwise reserved.

The peaceful distribution of informational materials in outdoor common areas does not, by itself, constitute a substantial or material disruption of the learning environment.

 Expressive activities are permitted during periods when College facilities are open to the general public.

 For purposes of this policy, examples of prohibited conduct include, but are not limited to:

• Violating the rights of others
• Defaming individuals
• Threats or harassment
• Invasion of privacy or confidentiality interests
• Blocking access to campus buildings or facilities
• Impeding pedestrian or vehicle traffic
• Obstructing entry or exit to College property or events
• Using audio amplification devices without College authorization
• Using fire or pyrotechnics
• Attaching materials to College buildings, equipment, fences, trees, or property without College authorization

 MCC does not assume responsibility for the content of expressive activities or distributed materials. Individuals engaging in expressive activities are responsible for any property damage, cleanup following activities, and compliance with applicable College policies and local, state, and federal laws.
